The agreement that governs how you work with ANZ Publishing House. Please read these terms carefully before using our services.
1. Introduction
Welcome to ANZ Publishing House. These terms and conditions set out the basis on which we provide book publishing, ghostwriting, editing, cover design, formatting, illustration, marketing, printing and author website services to authors across Australia, New Zealand and beyond.
By requesting a quote, placing an order, or using any part of our website or services, you agree to be bound by these terms. If you do not agree with them, please do not use our services. Specific projects may also be covered by a separate written proposal or service agreement, which will sit alongside these terms.
2. Definitions
In these terms, "we", "us", "our" and "ANZ Publishing House" refer to the business operating this website. "You", "your" and "the author" refer to the person or organisation requesting or using our services. "Services" means any of the publishing and creative services we offer. "Work" means the manuscript, files, artwork, content and deliverables connected with your project.
3. Our Services
We provide professional, fee-based services that help you produce and publish your book. We are a service provider, not a traditional royalty-paying publisher. This means you commission us to carry out the work, you keep full ownership of your book, and you keep 100% of any royalties your book earns.
The exact scope of each project, including the deliverables, number of revision rounds, and any third-party costs, is set out in the quote or proposal we provide before work begins. Anything outside that agreed scope may be quoted separately.
4. Quotes, Orders and Payment
Pricing is confirmed in a written quote after a free, no-obligation consultation. Our quotes are tailored to your project, so the figure reflects the services your book actually needs. A quote is valid for the period stated in it.
- Work begins once you accept your quote and any agreed deposit or payment is received.
- For larger projects we may agree a payment schedule with staged milestones.
- All fees are quoted in the currency shown on your quote and are exclusive of any third-party charges, such as printing costs, ISBN fees, paid advertising budgets, hosting or domain fees, unless stated otherwise.
- We do not take a share of your royalties or sales.
5. Author Responsibilities
To help your project run smoothly, you agree that:
- The work you provide is your own original material, or you hold the rights and permissions needed to use it.
- Your content does not infringe any third-party copyright, trademark or other right, and is not unlawful, defamatory or harmful.
- You will provide the materials, information, feedback and approvals we need in a reasonable timeframe.
- You are responsible for the factual accuracy of your book and its content.
Delays in providing materials or approvals may affect your project timeline.
6. Intellectual Property and Ownership
You own your book. On full payment for a project, the rights to the final approved deliverables we create for you, such as your cover design, interior files, illustrations or website, transfer to you. You retain copyright in your manuscript and creative work at all times.
We may showcase work we have completed, such as a published cover or title, in our portfolio and marketing, unless you ask us in writing not to. Any tools, templates, processes or know-how we use to deliver the work remain ours. Confidential ghostwriting projects are always treated as private, as described below.
7. Revisions and Approvals
Each service includes a defined number of revision rounds, set out in your quote, so we can refine the work until it is right. At key stages we will ask you to review and approve the work in writing before we move on. Once you approve a stage, further changes to that stage may be treated as additional work and quoted separately.
8. Timelines and Delivery
We provide an estimated timeline for every project and do our best to meet it. Timelines depend on the scope of work and on receiving your materials, feedback and approvals on time. Estimated dates are made in good faith and are not guaranteed, as some stages, including third-party printing and distribution, are partly outside our control.
9. Cancellations and Refunds
If you need to cancel a project, please let us know in writing as soon as possible. Because our work is provided as a personalised service, the amount refundable depends on how much work has already been carried out:
- Work that has not yet started is generally refundable, less any non-recoverable third-party costs already incurred on your behalf.
- Work already completed or in progress is charged for, and that portion of the fee is non-refundable.
- Third-party costs that have already been paid, such as printing, ISBNs or advertising spend, cannot be refunded.
Nothing in this section limits any rights you may have under the Australian Consumer Law or the New Zealand Consumer Guarantees Act.
10. Confidentiality
We treat your manuscript, personal details and project information as confidential and use them only to deliver your services. For ghostwriting and similar work, your identity and material stay private, and you are credited as the author. We can sign a separate confidentiality or non-disclosure agreement on request.
11. Third-Party Platforms
Publishing, printing and distribution often involve third-party platforms such as Amazon, Booktopia, Google Books, Apple Books, Ingram, Amazon KDP and IngramSpark. These platforms have their own terms, pricing and approval processes, which you agree to where relevant. We are not responsible for the decisions, delays, availability or policy changes of these third parties.
12. No Guarantee of Sales
We are committed to producing high-quality work and giving your book its best chance with readers. However, we cannot and do not guarantee any particular level of sales, reviews, rankings, income or commercial success, as these depend on many factors beyond our control, including the market and reader response.
13. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim connected with a project is limited to the fees you have paid us for that project. We are not liable for indirect or consequential loss, including loss of profits, sales, data or goodwill. Nothing in these terms excludes any liability that cannot lawfully be excluded.
14. Your Consumer Rights
Our services come with guarantees that cannot be excluded under the Australian Consumer Law and, for authors in New Zealand, under the Consumer Guarantees Act 1993. These terms operate alongside those rights and do not limit them. Where the law allows us to limit our liability, we do so as set out above.
15. Governing Law
These terms are governed by the laws of Australia. Where you are based in New Zealand, the relevant New Zealand consumer protections also apply. You agree to the non-exclusive jurisdiction of the courts of those places for any dispute. We will always try to resolve any concern with you directly and fairly first.
16. Changes to These Terms
We may update these terms from time to time to reflect changes in our services or the law. The current version will always be published on this page with the date it was last updated. The terms that apply to your project are those in force when you accept your quote.
